Save Garrett Wayne

This man didn’t get sentenced to death - but he is going to die behind bars without our help.

In May 2022, Garrett Wayne was in a horrific car accident, leaving the right side of his body paralyzed. This awful event makes it nearly impossible for Wayne to perform tasks essential for living without aid. Wayne has lost almost all ability to move and is left with severe pain. In the following year, he was also diagnosed with liver failure. Bedridden, disabled, and gravelly ill, Mr. Wayne, who has struggled with drug use in the past, tested positive for a controlled substance at a check-in with his parole officer from a previous drug related charge. 

In August of 2023, Wayne was incarcerated at FCI Gilmer in West Virginia on this parole violation. In his processing, the facility was given his medical records which explained Wayne’s physical condition and stage 4 liver failure. Wayne's stage 4 liver failure has caused mild brain impairment, liver leakage, and internal bleeding, an agonizing situation that requires immediate care. The five-year survival rate for men with stage 4 liver cancer is only 2.2%. However, his illness was ignored. When his condition became especially grave, he was taken to Stonewall Jackson Hospital. But instead of receiving the care he needed, to Wayne’s horror, his bodily autonomy was violated with the removal of his functional appendix and his gallbladder without his knowledge.

Due to tireless efforts from his mother, appalled at the treatment of her ill son, and with the help of Senator Todd Young, he was transferred from FCI Gilmer, a level 2 care facility, to FMC Butner, a level 4 care facility. While at FMC Butner, which is supposed to be able to provide more care, Wayne continues to face negligence which has only exacerbated his injuries. 

This should have been the end of his story, with Wayne receiving proper care and being able to heal in his new environment. Unfortunately, this was not the case. Wayne’s health problems continued to be neglected by the prison system even when he thought he was receiving the medical attention he so desperately needed. “[Prison officials] have worsened my condition so badly that I am now close to dying”. Garrett is only 31 years old. A man his age or any age should not have to suffer through so many health issues that have only been exacerbated by the lack of attention and care by the prison staff and administration. And a man with his condition is no risk to society, and should not be behind bars. 

In particular, the prison medical staff is not taking proper care of his liver leakage, which requires frequent draining or else he suffers debilitating pain and risks severe infection. Earlier this year he was diagnosed with sepsis in his stomach and almost lost his life but for “the grace of God” as his mother, Pamela, expressed. Despite his near death experience, Garrett is still not getting the frequent draining he needs. He is bedridden, overwhelmed with pain, and fearful for his life.

Being in a carceral facility does not provide Wayne with the care that he deserves if he was transferred to a proper hospital or granted a compassionate release so that he could be cared for by his family. He is set to be released on January 30th, 2025, which although only in a couple of weeks, is not soon enough. Every day counts when battling with these fatal conditions. Wayne is fighting for his survival and has a right to be surrounded by his family while he still can be. To live, Wayne needs a liver transplant, and this will not come quickly enough if he remains incarcerated.

At Wayne’s sentencing, his lawyer William Dazey did not let him speak, leaving him unable to advocate for himself. This prevented the judge from learning of his condition, which could have greatly increased his chances of getting a lighter sentence. When Wayne was sent to FCI Gilmer in August of 2023, Officer Jamie Roberts didn’t even state in his report that he was sick or would require any accommodations, further illustrating the deliberate indifference toward Garretts' medical needs. The Remedy Project has helped Garrett file a motion for compassionate release and the corresponding administrative remedies but FMC Butner has been hindering the administrative remedies that The Remedy Project prepared. This is an utter violation of Mr. Wayne’s rights. The administration is not even allowing Garrett to request the help and support he needs to survive. The conditions of a carceral state do not provide Garrett with the environment to alleviate his pain or support him in regular daily tasks that have become extremely difficult to perform due to the condition of his health.

Garrett doesn't have much time left, and his needs are dire and must be attended to immediately. Garrett should not spend the last weeks of his life suffering but surrounded by love, care, and his family. No one is deserving of such egregious negligence and torture. And, no one outside of prison is made “safer” by putting a disabled and terminally ill man in a cage. Allowing the continuation of Garretts' health to deteriorate is a form of abuse and torture that completely ignores his human rights. Garrett is a young man who does not deserve to die at the expense of medical malpractice and the prison administration's disregard for human life. The criminalization of Garrett has gone beyond punishment and his once minor incarceration is now an unnecessary and inhumane death sentence. Please help bring Garrett home so that he can be with his family, surrounded by the love and care he deserves. His medical needs need to be addressed by professionals who care for human life, not those who deliberately make his pain and suffering worse.
